GEN 4.2  Air navigation services charges

1.   TERMINAL AIR NAVIGATION SERVICES

1.1   GENERAL
The Bosnia and Herzegovina Air Navigation Services Agency (BHANSA) is responsible for provision of terminal air navigation services within TMA and CTR of international airports in Bosnia and Herzegovina (International Airport Sarajevo, International Airport Mostar, International Airport Tuzla and International Airport Banja Luka).
1.2   CALCULATION FORMULA
As a single operation it shall be considered one landing on and one take-off from the airport concerned.
Terminal charges are calculated in accordance with the following formula:
R = t x n
where R is the charge, t the unit rate of charge, and n the number of service units corresponding to such a flight.
The number of service units shall be obtained by means of the following formula:

where n is the number of service units, and p weight factor.
IFR flights:
The weight factor, expressed as a figure taken to two decimal places, shall be the quotient, obtained by dividing by fifty the number of metric tons in the highest maximum certified take-off weight of the aircraft, referred to in Annex IV point 1.5 of Commission Regulation (EC) No 1794/2006 of 6 December 2006 laying down a common charging scheme for air navigation services, to the power of 0.7.

VFR flights:
The weight factor, expressed as a figure taken to two decimal places, shall be the quotient, obtained by dividing by fifty the number of metric tons in the highest maximum certified take-off weight of the aircraft, referred to in Annex IV point 1.5 of Commission Regulation (EC) No 1794/2006 of 6 December 2006 laying down a common charging scheme for air navigation services, to the power of 0.5.

1.3   LEGAL BASIS FOR TERMINAL AIR NAVIGATION SERVICES AND EXEMPTIONS/REDUCTIONS
1.3.1   Legal basis for Terminal Navigation Services
For legal basis for Terminal Air Navigation Services see:
  • Commission Regulation (EC) No 1794/2006 of 6 December 2006 laying down a common charging scheme for air navigation services;
  • The Aviation Law of Bosnia and Herzegovina (“Official Gazette of Bosnia and Herzegovina” no. 39/9 & 25/18);
  • Regulation on determination on common charging scheme for air navigation services (“Official Gazette of Bosnia and Herzegovina” no.79/10);
  • Decree on Determining of Charges for Approach and Aerodrome Air Navigation Services at the International Airports of Bosnia and Herzegovina NO.1-01-10-16-3-5186/22;
1.3.2   Exemptions/reductions
From payments of terminal charges in Bosnia and Herzegovina exempted are the following flights:
  1. Flights performed by aircraft of which the maximum take-off weight authorized is less than two metric tons;
  2. Flights performed exclusively for the transport, on official mission, of the reigning Monarch and his immediate family, Heads of State, Heads of Government, and Government Ministers; in all cases, this must be substantiated by the appropriate status indicator on the flight plan;
  3. Search and rescue flights;
  4. Flights performed exclusively for the purpose of checking or testing radio navigation aids and air traffic control;
  5. Military flights of any country;
  6. Humanitarian flights and flights for the purpose of medical aids and fire fighting service;
  7. Customs and police flights;
  8. Flights terminating at the airport from which the aircraft has taken off and during which no intermediate landing has been made;
  9. Training flights performed exclusively for the purpose of obtaining a licence, or a rating in the case of cockpit flight crew, where this is substantiated by an appropriate remark on the flight plan, flights must be performed solely within the airspace of Bosnia and Herzegovina; flights must not serve for the transport of passengers and/or cargo, nor for positioning or ferrying of the aircraft.
1.4   METHOD OF PAYMENT
Charges shall be payable in BAM and EUR, and on payer’s request in other currencies. Exchange rate applied shall be the rate calculated by Central Bank of Bosnia and Herzegovina at the day of billing.

The latest value date by which payment must be received is 30 days from the date of the bill.

The person liable to pay the charge shall be the person who was the operator of the aircraft at the time when the flight was performed. If the identity of the operator is not known, the owner of the aircraft shall be regarded as the operator unless he proves which other person was the operator.
1.4.1   The rate of interest on late payment of Route Charges
The rate of interest on late payment of Terminal Charges shall be the one that is applied by the European Organization for the Safety of Air Navigation EUROCONTROL.

2.   ROUTE AIR NAVIGATION SERVICES

2.1   GENERAL
Bosnia and Herzegovina applies EUROCONTROL system to en-route charges and conditions of payment.
2.2   CALCULATION FORMULA
En-route charges are calculated in accordance with the formula from the EUROCONTROL Conditions of Application of the Route Charges System and Conditions of Payment.
2.2.1   Service unit rate
  1. Service unit rate for Bosnia and Herzegovina for 2024 is 26,33 EUR, applicable as of January 1, 2024;
  2. The service unit rate shall be recalculated monthly by applying the average monthly rate of exchange between the EUR and the national currency for the month preceding the month during which the flight takes place.
The exchange rate applied shell be the monthly average of the “Closing Cross Rates” calculated by Reuters based on daily BID rate.
2.3   LEGAL BASIS FOR AIR NAVIGATION SERVICES AND EXEMPTIONS/REDUCTIONS
2.3.1   Legal basis for Air Navigation Services
Legal basis for Route Air Navigation Services are: The Aviation Law of Bosnia and Herzegovina (“Official Gazette of Bosnia and Herzegovina” No 39/09 on 19/05/2009) and Regulation on determination on common charging scheme for air navigation services (“Official Gazette of Bosnia and Herzegovina” no. 79/10), Commission Regulation (EC) No 1794/2006 of 6 December 2006 laying down a common charging scheme for air navigation services.
2.3.2   Exemptions/reductions
In addition to the flights specified by the EUROCONTROL Conditions of Application of the Route Charges System, the following flights shall be exempted from the payment of charges:
  1. Flights performed under VFR rules – VFR flights;
  2. Training flights performed exclusively for the purpose of obtaining a license, or a rating in the case of cockpit flight crew, and where this is substantiated by an appropriate remark on the flight. These flights must be performed solely within the airspace of Bosnia and Herzegovina, and must not serve for the transport of passengers and/or cargo, nor for positioning or ferrying of the aircraft;
  3. Flights performed exclusively for the purpose of checking or testing equipment used or intended to be used as ground aids to air navigation, excluding positioning flights by the aircraft concerned;
  4. Flights terminating at the aerodrome from which the aircraft has taken off and during which no intermediate landing has been made (circular flights).
2.4   METHOD OF PAYMENT
Charges shall be collected in accordance with the EUROCONTROL Conditions of Payment.
2.4.1   The rate of interest on late payment of Route Charges
The rate of interest on late payments of route charges applicable as of 01 JAN 2024 is 13.26% per annum.
