Chapter 3 - General Procedures for the International Aeronautical Telecommunication Service

3.9.1The originator of a preliminary flight plan (FPF) or eFPL shall assign a single GUFI to a flight for which the flight plan is to be submitted.
3.9.2The originator of a PFP or eFPL shall ensure that all FF-ICE messages submitted for a flight are identified by the same GUFI.
3.9.3When providing a response to an FF-ICE message, an FF-ICE services unit shall identify the subject flight using the GUFI contained in the message.
3.9.4An FF-ICE services unit shall reject an FF-ICE message if the message includes a GUFI identical to that of another flight known to the FF-ICE services unit.
3.9.5 The format of a GUFI shall include a unique identification of the entity that generated the GUFI.
3.9.6The origination of a PFP or eFPL shall ensure that the GUFI assigned to the flight does not duplicate any other GUFI submitted by that originator within the past 10 years.“Remark: To be implemented under Subtask 6 of RMT.04 76.

DEROGATION
From the application of a Regulation/Standard to Bosnian and Herzegovinian Air Navigation Services Agency

CONDITIONS
This derogation is granted under the following conditions: Remains in force in AIP Bosnia and Herzegovina, in chapter GEN 1.7 Differences from ICAO Standards, Recommended Practices and Procedures, the published difference in relation to the requirement established in point 2.6.1, chapter 2.6 Airspace classification of ICAO Annex 11, as follows: Class G - IFR flights are not permitted.
In the same chapter of the AIP Bosnia and Herzegovina, a difference will be published in relation to the requirements established in SERA.6001 (7), Section 6 of the Order on the establishment of common flight rules and operational provisions regarding services and procedures in air navigation (“Official Gazette of Bosnia and Herzegovina” Number 58/23) as follows: Class G - IFR flights are not permitted.
In the same chapter of the AIP Bosnia and Herzegovina, a difference will be published in relation to the requirements established in Article 10. Paragraph (1) point g) of the Rulebook on Air Traffic Services (“Official Gazette of Bosnia and Herzegovina” Number 22/20) as follows: Class G - IFR flights are not permitted.
2.6.3Regulation laying down common rules of the air and operational provisions regarding services and procedures in air navigation („Official Gazette of Bosnia and Herzegovina“, No. 58/23) – Transposed Regulation (EU) 923/2012, SERA.6001 allows aircraft to exceed the 250 knot speed limit where approved by the competent authority for aircraft types, which for technical reasons, cannot maintain this speed. Remark: The difference corresponds to an exemption possibility and will exist only if the Bosnia and Herzegovina use it.Exemption possibility.

2.13.5Annex XI (Part –FPD) of Regulation laying down common requirements for providers of air traffic management, air navigation services and other air traffic management network functions and their oversight („Official Gazette of Bosnia and Herzegovina“, No. 10/23 and 78/23 – Transposed regulation (EU) 2017/373) Indicates a list of items to be used without indicating that (1) shall consist of (2)(3)(4)(5). However in AMC1 to Section III – (a)(2), the ICAO text of the ICAO Annex 11 Appendix 3, 2.1.1 is reproduced identically, but not consistent with Section III. Annex 11 Appendix 3, 2.1.1 (e) requires that the word „visual“ is used in the plain language designator when the route has been established for VFR, whereas the EU rule extends it to IFR in VMC as well (same difference is replicated in paragraph 5.3 Annex 11 Appendix 3). Annex 11 Appendix 3 para 6 (MLS/RNAV) is not transposed.Remark: Certain provision are transposed in AMC and GM to Section III of Appendix 1 to Annex XI (Part-FPD) of Transposed Regulation (EU) 2017/373 („Official Gazette of Bosnia and Herzegovina“, No. 10/23 and 78/23).
2.15.3Annex 11 Appendix 2, para 1.1 the terms „preferably VHF or higher frequency aids“ are not transposed. Para 4.2, 5.7 and 5.8 are not transposed. Remark: AMC1 Section IV of Appendix1 of Annex XI (Part –FPD) of Regulation laying down common requirements for providers of air traffic management/air navigation services and other air traffic management network functions and their oversight („Official Gazette of Bosnia and Herzegovina“, No. 10/23 and 78/23) – Transposed Regulation (EU) 2017/373 in point (b) sets out that designator or for a significant point should be marked by the site of a radio navigation aid, which is not an ICAO requirement.
2.18.3Details are provided with paragraph 2.19.
2.19.1Article 3c(1) of Regulation laying down common requirements for providers of air traffic management/air navigation services and other air traffic management network functions and their oversight („Official Gazette of Bosnia and Herzegovina“, No. 10/23 and 78/23) – Transposed Regulation (EU) 2017/373 refers to „air operations“ instead of „activities“, therefore, restricting the scope of the requirement. Transposed regulation does not specify with whom the coordination should be effected by omitting to specify the „appropriate air traffic services authorities“.
2.19.4Article 3c(2) refers to Art. 3c (1) Regulation laying down common requirements for providers of air traffic management/air navigation services and other air traffic management network functions and their oversight („Official Gazette of Bosnia and Herzegovina“, No 10/23 and 78/23) - Transposed Regulation (EU) 2017/373 which is transposition of paragraph 2.19.1 of Annex 11, therefore the same difference applies.
2.26.5Regulation laying down the common rules of the air and operational provisions regarding services and procedures in air navigation („Official Gazette of Bosnia and Herzegovina“, No. 58/23) – Transposed Regulation 923/2012, SERA.3401(d)(1), differs from ICAO Annex 11, standard 2.26.5 stating that:„Time checks shall be given at least to the nearest minute“Remark (Reason for Difference):SERA difference A11-01.

3.3.4SERA.8005(b) of Regulation laying down the common rules of the air and operational provisions regarding services and procedures in air navigation („Official Gazette of Bosnia and Herzegovina“, No. 58/23) – Transposed Regulation (EU) 923/2012 and ATS.TR.210(b) of Annex IV (Part – ATS) of Regulation laying down common requirements for providers of air traffic management/air navigation services and other air traffic management network functions and their oversight („Official Gazette of Bosnia and Herzegovina“, No. 10/23 and 78/23) – Transposed Regulation (EU) 2017/373, specifies:b) Clearances issued by air traffic control units shall provide separation:1. between all flights in airspace Classes A and B;2. between IFR flights in airspace Classes C, D and E;
3. between IFR flights and VFR flights in airspace C;4. between IFR flights and special VFR flights.5. between special VFR flights unless otherwise prescribed by the competent authority; except that, when requested by the pilot of an aircraft and if so prescribed by the competent authority for the cases listed under (b) above in airspace Classes D and E, a flight may be cleared subject to maintain own separation in respect of a specific portion of the flight bellow 3050 m (10000 ft) during climb or descent, during day in visual meteorological conditions.Remark (reason for difference):SERA Difference A11-03.
3.7.3.1Regulation laying down the common rules of air and operational provisions regarding services and procedures in air navigation („Official Gazette of Bosnia and Herzegovina“, No. 58/23) – Transposed Regulation (EU) 923/2012, SERA.8015(e) specifies (with the addition to ICAO Standard in Annex 11, 3.7.3.1 of the underlined text):e) Read-back of clearances and safety related information.1. The flight crew shall read back to the air traffic controller safety related parts of ATC clearances and instructions which are transmitted by voice. The following items shall always be read back:i) ATC route clearances;ii) clearances and instructions to enter, land on, take off from, hold shot of, cross, taxi and backtrack on any runway; andiii) runway in use, altimeter settings, SSR codes, newly assigned communication channels, level instructions, heading and speed instructions; andiv) transition levels, whether issued by the controller or contained in ARIS broadcast.
